Basic Documents Required Before Registration
Once the property has been finalized and the E-Khata and tax details have been verified, the next step is to prepare the basic documents required for initiating the registration process.
For a typical property sale transaction in Karnataka, the basic documents generally required to be uploaded or provided for registration include:
1. Updated E-Khata of the Property
The updated E-Khata of the property is an important document for the registration process. The property details should be properly updated in the records of the concerned local authority.
The current year’s applicable property tax should also be paid and the payment should be reflected in the concerned online records before proceeding with registration.
2. Aadhaar Card
The Aadhaar details of the parties to the transaction are generally required as part of the registration process and for identity verification.
3. PAN Card
The PAN details of the buyer and seller, wherever applicable, are required for the registration and related statutory formalities.
4. Draft Sale Deed
A draft Sale Deed containing the details and terms of the proposed transaction is prepared before registration.
The draft should be carefully checked to ensure that the names, property description, measurements, boundaries, consideration, title details and other relevant particulars are correctly incorporated.
These Are Only the Basic Registration Documents
It is important to understand that the above documents should not be treated as a complete list of documents required for verifying the property.
The fact that the basic documents are sufficient to initiate or proceed with the registration process does not, by itself, establish that the property has a clear and marketable title.
Buyers Should Obtain the Complete Property Documents
It is advisable for the purchaser to obtain all relevant property documents available with the seller and have them examined by the purchaser’s advocate before completing the transaction.
Depending upon the nature and history of the property, the documents requiring examination may include previous sale deeds, title documents, partition or inheritance documents, conversion orders, layout approvals, Khata records, tax-paid receipts, encumbrance records, allotment documents, release deeds, court-related documents and other relevant records.
The documents required will vary depending upon the nature, location, ownership history and legal status of the property.
Legal Verification Before Registration
Registration of a Sale Deed is an important legal step, but registration alone should not be treated as a substitute for title verification.
A prudent purchaser should ensure that the available property documents are collected and examined by an advocate before making the final payment and proceeding with registration.
